What is Premise liability?
The owner of any property, commercial or residential, has a responsibility to maintain a safe environment for those who visit. When there are dangers that cannot be rectified, property owners have the responsibility to warn potential visitors of those dangers. Premises liability is an area of the law that is intended to protect and provide compensation to those who are injured as a result of a negligent property owner.
As in any legal issue, there are a number of elements that come into play in premises liability cases. Was the property owner aware of the hazardous situation? Did they fail to correct a situation that they should have been aware of? Did the property owner’s actions or failure to act lead to the injury? The status of the visitor who is injured is another element that must sometimes be considered in premises liability. Was the injured person an invitee, someone who was invited on the property for the purpose of doing business? Or a licensee, someone who visits as a social guest? Or was the injured person a trespasser? In some instances, a property owner might not have the same responsibilities to a trespasser.
